MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A8136 SPONSOR: McDonald
  TITLE OF BILL: An act to amend the public authorities law, in relation to the scheduling of meetings of the board of the Albany convention center authority   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to change the schedule of meetings of the board of the Albany Convention Center Authority from monthly to quarter- ly.   SUMMARY OF SPECIFIC PROVISIONS: Section one of this bill amends subdivision 6 of section 2675-d of the public authorities law to require the Albany Convention Center Authority board to hold quarterly meetings on an annual basis. Section two provides for an immediate effective date.   JUSTIFICATION: Currently, the Albany Convention Center Authority (ACCA) Board is required to meet on a monthly basis as enacted in the ACCA enabling legislation. The planning, development, and construction phases of the ACCA mission statement have been completed as of March 2017 and a full- time manager for the Albany Capital Center has been contracted. Accord- ingly, the ACCA Board meeting on a quarterly basis during the operations phase would lead to more efficiency in the execution of its fiduciary duties. A quarterly meeting schedule would coincide well with the opera- tor reporting functions, the quarterly distribution of the Albany County Hotel Motel Occupancy Tax (H.C.T.) while still providing both account- ability and transparency in all business matters to come before The Albany Convention Center Authority.   PRIOR LEGISLATIVE HISTORY: New Bill

McDONALD, FAHY -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to the schedul- ing of meetings of the board of the Albany convention center authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 2675-d of the public authorities 2 law, as added by chapter 468 of the laws of 2004, is amended to read as 3 follows: 4 6. The board shall hold at least one regular meeting [every month] 5 quarterly. The chairperson, or in his or her absence the vice-chairper- 6 son, or any four members, may call a special meeting by notice as speci- 7 fied by the board. All meetings of the board shall be subject to arti- 8 cle seven of the public officers law. 9 § 2. This act shall take effect immediately.
