TITLE OF BILL: An act to amend the public health law, in relation to
the use of insect repellent by a child attending summer camp
 
PURPOSE:
To allow children attending overnight camp, summer day camp, and travel-
ling summer day camp to be able to use insect repellent with the written
permission of a parent or guardian.
 
SUMMARY OF PROVISIONS:
Section 1 amends section 1394 of the public health law by allowing chil-
dren in overnight camp, summer day camp, and travelling summer day camp
to carry and use insect repellent with the written permission of a
parent or guardian of any child. Any child who is unable to physically
apply insect repellent may be assisted by unlicensed personnel when
directed by the child to do so, if permitted by a parent or guardian and
authorized by the camp. A record of permission shall be maintained by
the camp.
Section 2 establishes the effective date.
 
JUSTIFICATION:
Children in overnight camp, summer day camp, and travelling summer day
camp are most vulnerable to the ever increasing risk of contracting a
disease transmitted through insects. With parent's written permission,
children must be given the opportunity to safeguard themselves. It is
imperative that we afford them this opportunity.

EFFECTIVE DATE:
This act shall take effect immediately after it shall have become law.

AN ACT to amend the public health law, in relation to the use of insect

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1394 of the public health law is amended by adding
2 a new subdivision 5 to read as follows:
3 5. Each children's overnight camp, summer day camp and traveling
4 summer day camp shall allow children attending such camp to carry and
5 use insect repellent with the written permission of a parent or guardian
6 of any child. A record of such permission shall be maintained by the
7 camp. A child who is unable to physically apply insect repellent may be
8 assisted by unlicensed personnel when directed to do so by the child, if
9 permitted by a parent or guardian and authorized by the camp.
10 § 2. This act shall take effect immediately.
