MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the public health law and the education law, in relation to allowing pharmacies to electronically transfer prescriptions to other pharmacies   PURPOSE: To allow pharmacies to electronically transfer initial electronic prescriptions to other pharmacies.   SUMMARY OF PROVISIONS: Section one amends § 281 of the public health law to authorize a pharma- cy that is unable to fill an initial electronic prescription, to trans- fer that prescription electronically to another pharmacy. Section two amends § 6810 of the education law to authorize a pharmacy that is unable to fill an initial electronic prescription, to transfer that prescription electronically to another pharmacy. Section three is the effective date.   JUSTIFICATION: The majority of medical prescriptions in New York are now required to be done electronically. While electronic prescriptions (e-scripts) have tremendous advantages, including certain securities and efficiencies, there are some circumstances where e-scripts are problematic. Specif- ically, regarding initial prescriptions where the pharmacy receiving the initial e-script is unable to immediately fill the script, patients have to go back to their health care provider for the e-script to be sent to another pharmacy, rather than being able to direct the pharmacy itself to transfer the e-script to another pharmacy that is able to fill the script.   LEGISLATIVE HISTORY: This is a new bill.   FISCAL: None to the State.   EFFECTIVE DATE: This act shall take effect on the ninetieth day after it shall have become a law.

        AN ACT to amend the public health law and the education law, in relation
          to allowing pharmacies to  electronically  transfer  prescriptions  to
          other pharmacies
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 281 of the public health law is amended by adding a
     2  new subdivision 3-a to read as follows:
     3    3-a. A pharmacy that receives  an  electronic  prescription  from  the
     4  person  issuing  the  prescription may, if the prescription has not been
     5  dispensed and at the request of the patient or a  person  authorized  to
     6  make  the  request  on  behalf  of  the patient, immediately transfer or
     7  forward such prescription to an alternative pharmacy designated  by  the
     8  requesting party.
     9    §  2.  Section  6810  of  the education law is amended by adding a new
    10  subdivision 10-a to read as follows:
    11    10-a. A pharmacy that receives an  electronic  prescription  from  the
    12  person  issuing  the  prescription may, if the prescription has not been
    13  dispensed and at the request of the patient or a  person  authorized  to
