        Introduced  by  Sen.  SAVINO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health law, in relation to  the  registration
          of medical marihuana manufactures and dispensing sites
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 9 of section 3365 of the public health law,  as
     2  added by chapter 90 of the laws of 2014, is amended to read as follows:
     3    9.  The commissioner shall initially register no more than five regis-
     4  tered organizations that manufacture medical marihuana with no more than
     5  four dispensing sites wholly  owned  and  operated  by  such  registered
     6  organization.  The commissioner shall ensure that such registered organ-
     7  izations and dispensing sites are geographically distributed across  the
     8  state.    The  commissioner shall register no more than five retail-only
     9  registered organizations by no later than the first of August two  thou-
    10  sand  seventeen for the sole purpose of operating dispensing sites. Each
    11  retail-only registered organization shall be entitled to operate as many
    12  dispensing sites as the commissioner determines necessary to  adequately
    13  meet the needs of certified patients. The commissioner shall ensure that
    14  such  dispensing  sites are geographically distributed across the state.
    15  The [commission] commissioner may register additional registered  organ-
    16  izations  upon  the earlier of the first of September two thousand eigh-
    17  teen or when the number of patients certified by their  practitioner  to
    18  possess  marihuana  pursuant to this title exceeds one hundred thousand.
    19  The commissioner may give preference to retail-only registered organiza-
    20  tions in granting  registrations  beyond  the  initial  five  registered
    21  organizations.
    22    §  2. This act shall take effect immediately; provided that the amend-
    23  ments to subdivision 9 of section 3365 of the public health law made  by
    24  section  one of this act shall not affect the repeal of such section and
    25  shall be deemed repealed therewith.
