AN ACT to amend the vehicle and traffic law, in relation to implementing
a residential parking system in the city of Rye
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative findings and intent. The legislature finds that
2 a lack of parking for residents of a section of the City of Rye has
3 resulted in traffic hazards, congestion, and air and noise pollution.
4 On-street parking in this area has been limited due to visitors, commu-
5 ters, and train passengers parking in the neighborhood for its free
6 parking and close proximity to the nearby commercial business district,
7 local YMCA and Rye Metro-North train station. The lack of parking for
8 residents also poses a hazard to residents and other pedestrians in such
9 area. The legislature further finds that a residential parking system
10 within such area will reduce such hazards and pollution levels as well.
11 The legislature, therefore, hereby declares the necessity of this act to
12 authorize the City of Rye in the county of Westchester to adopt a resi-
13 dential parking permit system in accordance with the provisions of this
14 act.
15 § 2. The vehicle and traffic law is amended by adding a new section
16 1640-r to read as follows:
17 § 1640-r. Residential parking system in the city of Rye. 1. Notwith-
18 standing the provisions of any law to the contrary, the city council of
19 the city of Rye may, by adoption of a local law or ordinance, provide
20 for a residential parking permit system and fix and require the payment
21 of fees applicable to parking within the area in which such parking
22 system is in effect in accordance with the provisions of this section.
23 2. Such residential parking permit system may only be established
24 within the city of Rye on Mead Place.
25 3. Notwithstanding the foregoing, no permit shall be required on
26 streets or those portions of such streets where the adjacent properties
27 are zoned for commercial/retail use.

1 4. The local law or ordinance providing for such residential parking
2 system shall:
3 (a) set forth factors necessitating the enactment of such parking
4 system; and
5 (b) provide that motor vehicles registered pursuant to section four
6 hundred four-a of this chapter shall be exempt from any permit require-
7 ment; and
8 (c) provide the times of the day and days of the week during which
9 permit requirements shall be in effect; and
10 (d) make not less than twenty percent of all spaces within the permit
11 area available to non-residents, and shall provide short-term parking of
12 not less than ninety minutes in duration in such area; and
13 (e) provide the schedule of fees to be paid for such permits; and
14 (f) provide that such fees shall be credited to the general fund of
15 the city.
16 5. No ordinance shall be adopted pursuant to this section until a
17 public hearing thereon has been had in the same manner as required for
18 public hearings on a local law pursuant to the municipal home rule law.
19 § 3. This act shall take effect immediately.
