        AN ACT to amend the public health law, in relation to  adding  an  acute
          children's hospital to the term enhanced safety net hospital
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (a) of subdivision 34 of section  2807-c  of  the
     2  public  health law, as added by section 3 of part K of chapter 57 of the
     3  laws of 2018, is amended to read as follows:
     4    (a) For the purposes of this subdivision, "enhanced safety net  hospi-
     5  tal" shall mean a hospital which:
     6    (i) in any of the previous three calendar years, has met the following
     7  criteria:
     8    (A)  not  less  than  fifty  percent of the patients it treats receive
     9  medicaid or are medically uninsured;
    10    (B) not less than  forty  percent  of  its  inpatient  discharges  are
    11  covered by medicaid;
    12    (C) twenty-five percent or less of its discharged patients are commer-
    13  cially insured;
    14    (D)  not  less than three percent of the patients it provides services
    15  to are attributed to the care of uninsured patients; and
    16    (E) provides care to uninsured patients in its emergency room,  hospi-
    17  tal  based  clinics and community based clinics, including the provision
    18  of important community services, such as dental care and prenatal care;
    19    (ii) is a public hospital operated by a county,  municipality,  public
    20  benefit corporation or the state university of New York;
    21    (iii)  is  an  acute  children's  hospital  licensed by the department
    22  primarily for the provision of pediatric and neonatal services for which

     1  a discrete institutional cost report was filed for the past three calen-
     2  dar years, and which has medicaid discharges in excess of fifty  percent
     3  of its total discharges;
     4    (iv) is federally designated as a critical access hospital; or
     5    [(iv)] (v) is federally designated as a sole community hospital.
     6    § 2. This act shall take effect immediately.
