        Introduced  by M. of A. DARLING -- read once and referred to the Commit-
          tee on Corporations, Authorities and Commissions
 
        AN ACT to amend the public service law, in relation to requiring  utili-
          ties to repair certain roadways
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 5 of the public service law is amended by adding  a
     2  new subdivision 7 to read as follows:
     3    7.  The commission shall require any utility subject to the provisions
     4  of this chapter to repair and restore  to  its  original  condition  any
     5  state  or  local  highway  located  in  a  city, county, town or village
     6  outside of a city with a population of one  million  or  more,  that  it
     7  disturbs or destroys while maintaining its respective service.
     8    § 2. This act shall take effect on the one hundred twentieth day after
     9  it  shall have become a law. Effective immediately, the addition, amend-
    10  ment and/or repeal of any rule or regulation necessary for the implemen-
    11  tation of this act on its effective date are authorized to be  made  and
    12  completed on or before such effective date.
