AN ACT to amend the public health law, in relation to requiring hospi-
tals to provide certain information to patients who have suffered a
traumatic brain injury
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 2803-bb to read as follows:
3 § 2803-bb. Traumatic brain injury information distribution. 1. For the
4 purposes of this section, "traumatic brain injury" shall mean any
5 acquired brain injury resulting from sudden trauma causing damage to the
6 brain.
7 2. The commissioner shall design an informational packet about trau-
8 matic brain injuries and shall require that every general hospital
9 distribute such packet to all patients, caregivers, and family of
10 patients who have suffered a traumatic brain injury.
11 3. Such packet shall include, but not be limited to, information
12 regarding short-term and long-term care options for traumatic brain
13 injury patients, resources for obtaining such care, and current best
14 practices on post-traumatic brain injury care and rehabilitation. Such
15 packet shall additionally, wherever practicable, avoid the use of
16 medical terminology and instead use words with common and everyday mean-
17 ings to facilitate understanding. The information contained within said
18 packet shall also be posted on the department's website.
19 4. In preparing the information regarding traumatic brain injuries as
20 provided in this section, the commissioner shall consult with appropri-
21 ate health care professionals and the commissioner shall ensure that the
22 information is maintained and updated to reflect future changes to clin-
23 ical guidelines.
24 § 2. This act shall take effect immediately.
