        AN  ACT  to amend the vehicle and traffic law, in relation to a fine for
          parked or unattended semitrailers or trailers on  streets  of  a  city
          with a population of one million or more

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph 2 of subdivision (b) of section 1204 of the vehi-
     2  cle and traffic law, as amended by chapter 193 of the laws of  1974,  is
     3  amended and two new paragraphs 3 and 4 are added to read as follows:
     4    2.  In any city with a population of one million or more, whenever any
     5  police officer, or any person designated by the commissioner  [of  traf-
     6  fic], finds a semitrailer or trailer without a tractor or towing vehicle
     7  attached,  parked  or  unattended  on  any  city street, such officer or
     8  person designated by the commissioner [of traffic] is hereby  authorized
     9  to  provide  for the removal of such semitrailer or trailer to a garage,
    10  automobile pound or other place of safety.
    11    3. The owner of a semitrailer or trailer without a tractor  or  towing
    12  vehicle  attached,  parked  or  unattended  on any city street, shall be
    13  subject to a fine not to exceed one thousand dollars.
    14    4. If a semitrailer or trailer without a  tractor  or  towing  vehicle
    15  attached  is  parked  and left unattended on any street in a city with a
    16  population of one million or more while it is used  for  film  or  tele-
    17  vision production, the owner of such semitrailer or trailer shall not be
    18  subject  to the fine as provided in paragraph three of this subdivision,
    19  provided that such semitrailer or trailer is parked in  accordance  with
    20  the  requirements  of any permit issued by such city relating to the use
    21  of semitrailers or trailers being used in connection with film or  tele-
    22  vision production.
    23    §  2.  Subdivision 2 of section 237 of the vehicle and traffic law, as
    24  amended by chapter 458 of the laws  of  2010,  is  amended  to  read  as
    25  follows:

     1    2.  To  provide  for penalties other than imprisonment for (a) parking
     2  violations in accordance with a schedule of monetary  fines  and  penal-
     3  ties,  provided  however, that monetary penalties shall not exceed fifty
     4  dollars for each parking violation other than (i) in a city with a popu-
     5  lation  of  one  million  or  more, violations committed in spaces where
     6  stopping or standing is prohibited for which  monetary  penalties  shall
     7  not  exceed one hundred dollars and, (ii) handicapped parking violations
     8  for which monetary penalties shall not exceed one hundred fifty dollars;
     9  and (b) abandoned vehicle violations, except in a city with a population
    10  of one million or more, provided however, that monetary penalties  shall
    11  not  be  less  than two hundred fifty dollars nor more than one thousand
    12  dollars for each abandoned vehicle violation; and  (c)  a  city  with  a
    13  population of one million or more may impose a monetary penalty of up to
    14  [two  hundred  fifty  dollars for a first offense and up to five hundred
    15  dollars for subsequent offenses within a six month period] one  thousand
    16  dollars  for  tractor-trailer combinations, tractors, truck trailers and
    17  semi-trailers parked overnight on streets in residential neighborhoods;
    18    § 3. This act shall take effect on the ninetieth day  after  it  shall
    19  have become a law. Effective immediately, the addition, amendment and/or
    20  repeal  of  any  rule  or regulation necessary for the implementation of
    21  this act on its effective date are authorized to be made  and  completed
    22  on or before such effective date.
