AN ACT authorizing the county of Suffolk to alienate certain lands used
as parklands to enable Sunrise Wind, LLC to construct, maintain and

Smith Point County Park and Smith Point County Marina and appurtenanc-

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, the county of
2 Suffolk is hereby authorized, acting by and through its governing body,
3 and upon such terms and conditions as determined by such governing body,
4 to: (a) temporarily discontinue the use of the parklands described in
5 section three of this act; and (b) to discontinue the use as parkland
6 and alienate the lands described in section four of this act, and convey
7 such lands to Sunrise Wind, LLC for the purpose of constructing, main-
8 taining and operating a subterranean conduit and electrical distribution
9 cable system, together with subterranean transition joint bays and link
10 boxes, and appurtenances thereto, on county of Suffolk parkland located
11 at Southaven County Park, Smith Point County Park and Smith Point County
12 Marina.
13 § 2. The authorization contained in section one of this act shall only
14 be effective on the condition that the county of Suffolk dedicate an
15 amount equal to or greater than fair market value of the parklands being
16 alienated pursuant to section one of this act towards the acquisition of
17 new parklands and/or capital improvements to existing park and recre-
18 ational facilities.
19 § 3. The parklands authorized by section one of this act to be tempo-
20 rarily discontinued as parkland for construction are described as
21 follows:

44 § 5. Upon completion of construction, Sunrise Wind, LLC, as authorized
45 by this act in agreement and in consultation with the Suffolk County
46 Department of Parks, Recreation & Conservation, shall restore the
47 surface of the lands more particularly described in section three of
48 this act and such lands shall continue to be used for park purposes.
49 § 6. In the event that the county of Suffolk received any funding
50 support or assistance from the federal government for the purchase,
51 maintenance, or improvement of the parklands set forth in sections three
52 and four of this act, the discontinuance and alienation of such park-
53 lands authorized by the provisions of this act shall not occur until the
54 county of Suffolk has complied with any federal requirements pertaining
55 to the alienation or conversion of parklands, including satisfying the
56 secretary of the interior that the alienation or conversion complies

1 with all conditions which the secretary of the interior deems necessary
2 to assure the substitution of other lands shall be equivalent in fair
3 market value and usefulness to the lands being alienated or converted.
4 § 7. This act shall take effect immediately.
