AN ACT to amend the insurance law, the vehicle and traffic law and the
workers' compensation law, in relation to electronic delivery of
notices
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (b) of section 3458 of the insurance law, as
2 amended by chapter 161 of the laws of 2022, is amended to read as
3 follows:
4 (b) Subject to the requirements of this section, any notice to a party
5 or any other document required under this chapter, paragraph (c) of
6 subdivision one of section three hundred thirteen of the vehicle and
7 traffic law, and paragraph (a) of subdivision five of section fifty-four
8 of the workers' compensation law in a property/casualty insurance trans-
9 action or that is to serve as evidence of property/casualty insurance
10 coverage may be delivered by electronic means so long as it meets the
11 requirements of article three of the state technology law. Where this
12 chapter requires that notice be mailed or delivered to an address shown
13 in the policy, the notice may be delivered by electronic means to an
14 electronic address not specified in the policy.
15 § 2. Subdivision 1 of section 313 of the vehicle and traffic law is
16 amended by adding a new paragraph (c) to read as follows:
17 (c) An electronic notice that complies with section three thousand
18 four hundred fifty-eight of the insurance law shall be sufficient for
19 the purposes of this section.
20 § 3. Paragraph (a) of subdivision 5 of section 54 of the workers'
21 compensation law is amended by adding a new undesignated paragraph to
22 read as follows:
23 An electronic notice that complies with section three thousand four
24 hundred fifty-eight of the insurance law shall be sufficient for the
25 purposes of this section.
26 § 4. This act shall take effect immediately.
