AN ACT to amend the vehicle and traffic law, in relation to allowing the
federal government access to certain department of motor vehicles
information for the purposes of reviewing applications for federal
programs, federal law enforcement, national security and used car
exports; and to repeal certain provisions of such law related thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 12 of section 201 of the vehicle and traffic
2 law is REPEALED and two new subdivisions 12 and 13 are added to read as
3 follows:
4 12. Notwithstanding subdivisions eight, nine, ten, and eleven of this
5 section, when a federal agency that primarily enforces immigration law,
6 including but not limited to United States immigration and customs
7 enforcement and United States customs and border protection, or any
8 successor agencies having similar duties requests documents, records, or
9 other information for the purposes of such agency's review of an appli-
10 cation submitted by a person for a federal program, or for the purposes
11 of investigating a person for federal law enforcement and/or national
12 security issues, the commissioner shall disclose and otherwise make
13 accessible any requested documents, records, or other information where
14 the subject of the request is the subject of such documents, records, or
15 other information.
16 13. Notwithstanding subdivisions eight, nine, ten, eleven and twelve
17 of this section, when a federal agency that primarily enforces immi-
18 gration law, including but not limited to United States immigration and
19 customs enforcement and United States customs and border protection, or
20 any successor agencies having similar duties requests documents,
21 records, or other information for the purposes of such agency approving
22 a vehicle for export, the commissioner shall disclose and otherwise make
23 accessible any requested documents, records, or other information where
24 the vehicle pending approval is the subject of such documents, records,
25 or other information.
26 § 2. This act shall take effect immediately.
