TITLE OF BILL:
An act to amend the public service law, in relation to requiring certain
information to be filed with department of public service
 
PURPOSE:
The purpose of this bill is to ensure fuel gas transmission lines of all
pressures are regulated, inspected, and mapped by the Public Service
Commission.
 
SUMMARY OF PROVISIONS:
Section 1 amends subdivision 2 of section 120 of the public service law
to change the description of fuel gas transmission line to include tran-
smission lines of any pressure used to transport fuel gas.
Section 2 establishes an effective date of thirty days after the act
shall have become law; and directs the addition, amendment and/or repeal
of any rule or regulation necessary for the implementation of the act on
or before such effective date.
 
JUSTIFICATION:
In light of the push to develop the Marcellus and other shales, many
landowners, farmers, environmental advocates, and others have expressed
concerns over the lack of oversight of fuel gas transmissions lines.
Currently, low pressure transmission lines (lines with pressures of 124
pounds per square inch (psi) or less) are not regulated, inspected, or
mapped in any systematic way. This bill provides regulators with up to
date information on the development of infrastructure related to fuel
gas transmissions.

AN ACT to amend the public service law, in relation to requiring certain
information to be filed with department of public service
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public service law is amended by adding a new section
2 121-b to read as follows:
3 § 121-b. Filing of certain information. 1. All persons who intend to
4 construct a gas gathering line or a pipeline facility, shall file with
5 the department spatial mapping data, including but not limited to
6 geographic information system data, detailing the location of such
7 proposed gathering line or pipeline facility.
8 2. The department, in consultation with the department of environ-
9 mental conservation, shall establish and maintain a computer mapping
10 system for plotting the location of gathering lines and pipeline facili-
11 ties. Such maps shall overlay locations subject to the provisions of
12 article twenty-three of the environmental conservation law.
13 3. For purposes of this section, the following terms shall have the
14 following meanings:
15 (a) "Gathering line" means a pipeline that transports gas from a
16 current production facility to a transmission line, main, or directly to
17 an end user.
18 (b) "Pipeline facility" means new and existing pipeline, rights-of-
19 way, and any related equipment, facility, or building, used in the
20 transportation of gas, or in the treatment of gas during the course of
21 transportation, in connection with the production, gathering, treatment
22 or processing of such gas, but does not include any: (i) transmission
23 and distribution system operated by a local distribution company subject
24 to the jurisdiction of the commission for purposes of providing retail
25 utility service; or (ii) transmission pipeline constructed by a natural

1 gas company under the authority of the federal Natural Gas Act (15
2 U.S.C.A. Section 717 et seq.). The department shall have the option to
3 incorporate any additional information regarding pipeline facilities.
4 § 2. This act shall take effect on the one hundred eightieth day after
5 it shall have become a law, provided however, that effective immediate-
6 ly, the addition, amendment and/or repeal of any rule or regulation
7 necessary for the implementation of this act on its effective date are
8 authorized and directed to be made and completed on or before such
9 effective date.
