Assemblyman Cahill Issues Reminder About Tax Exempt Status of Flag Purchases

Assemblyman Kevin A. Cahill (D-Kingston) would like to remind area residents and retailers that New York State and United States flags are exempt from sales tax.

The New York State Department of Taxation and Finance Sales and Compensating Use Tax Regulations specify that flags and any accessories that are used solely for the display of the flag and are sold with the flag for a single charge are exempt as well. This reminder comes on the heels of a phone call from an alert constituent to Mr. Cahill’s District Office questioning a recent flag purchase at a local establishment where sales tax was inadvertently charged.

“Although the situation was handled deferentially by a staff person in my office and the merchant expressed thanks for having this brought to his attention, it is important that consumers be informed,” said the Assemblyman. “Since September 11th, there is an increased interest on the part of many Americans to express their patriotism. Flag sales have risen nationwide, and remembering this information will be helpful to those wishing to make a purchase,” he concluded.
