LEGISLATIVE ACTION
The Legislature provides $500,518,281 on an All Funds basis, an
increase of $10,087,281 to the Executive budget submission to augment
funding in several significant program areas having statewide impact.
The Executive proposal included no increases in program support and no
program expansion at a time when chemical abuse is a serious societal
problem. The impact of chemical abuse is felt in our health system,
our criminal justice system and our social welfare system. Its worst
impact is felt by our children. Chemical abuse and dependence are
significant factors in more than seventy percent of foster care
placements. Our courts, jails and hospitals all deal with the
aftermath of addressing this problem inadequately.
Legislative Changes
The Legislature takes the following actions to strengthen the
alcoholism and substance abuse prevention and treatment system:
-- Adds $3,400,000 to provide a one and one-half percent cost of
living adjustment for non-residential providers of alcoholism and
substance abuse prevention and treatment services;
-- Provides $2,000,000 for increased support or expansion of alcohol
and substance abuse school and community based prevention
programs;
-- Adds $2,000,000 for increased support or expansion of alcohol and
substance abuse treatment programs;
-- Provides $500,000 to develop and implement programs providing
community transition services to assist persons completing
chemical abuse treatment to achieve success in independent
living.
Article VII
-- The Legislature approves legislation that would continue
authorization for federal Disproportionate Share payments to
certain Article 28 hospitals providing mental health services to
uninsured and low income patients.
-- The Legislature approves legislation that would increase the
Department of Mental Hygiene (DMH) bond cap by $650,000,000 to a
total of $5,050,000,000.
-- The Legislature approves legislation that would authorize the use
of Capital Projects funds, including bond proceeds, for personal
service and non-personal service costs associated with
construction projects carried out by State employees.
-- The Legislature approves legislation that would permit capital
funds appropriated to the Office of Alcoholism and Substance
Abuse Services (OASAS) to be paid to the Dormitory Authority of
the State of New York (DASNY) as reimbursement for funds
disbursed for capital projects.
-- In order to carry out its oversight responsibilities, the
Legislature approves legislation that would require monthly
reports on capital projects funded with bond proceeds, when those
projects are funded pursuant to appropriations or
reappropriations made to OASAS in the annual budget and
transferred to DASNY pursuant to law. Such reports would be made
to the Chairs of the Assembly Ways and Means Committee and the
Senate Finance Committee, the State Comptroller, the Director of
the Budget and the Commissioner of OASAS. Such reports would be
made by the tenth of each month and would include, by
appropriation, monthly cash disbursements and expenditures, life-
to date disbursements and expenditures, and amounts encumbered
yet undisbursed.
-- The Legislature denies legislation that would permit bond
proceeds to be used for demolition and environmental remediation
projects.
