TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to curb repair
 
PURPOSE:
This bill mandates that all curb and_curb cut repairs shall be the
responsibility of the City of New York and any repairs at a one, two, or
three family homes shall be repaired no later than ninety days after the
department receives the complaint. If the repair is not competed within
90 days, a homeowner may have the work completed by a licensed contrac-
tor and is entitled to a property tax credit for the reasonable cost.
 
SUMMARY OF PROVISIONS:
The bill amends section 19-ill of the administrative code of the city of
New York. Owners of one, two, or three family homes must make curb and
curb cut repair requests on NYC 311 or the official website of the city
of New York. The requests must be completed ninety days from the date
the department receives the complaint and if that deadline is not met,
the owner is entitled to hire a licensed contractor to do the repairs
and receive a property tax credit for the cost of the repair.
 
JUSTIFICATION:
Often it takes many months or years for curbs to be fixed after initial
reporting. This bill gives homeowners the ability to have maintenance
completed with little expenditure if not corrected by the city within
ninety days.

AN ACT to amend the administrative code of the city of New York, in
relation to curb repair
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 19-111 of the administrative code of the city of
2 New York, as amended by local law number 104 of the city of New York for
3 the year 1993, is amended to read as follows:
4 § 19-111 Curbs. All curbs for the support of sidewalks hereafter to be
5 laid shall be of the material or materials, dimensions and construction
6 required in department specifications for such work, which shall be
7 prescribed by the commissioner and kept on file in his or her office.
8 All curb and curb cut repairs shall be the responsibility of the depart-
9 ment and any owner of a one, two or three family home, after making his
10 or her request on NYC 311, the official website of the city of New York,
11 shall be entitled to have all repairs completed within a reasonable
12 amount of time. For the purposes of this section, "reasonable amount of
13 time" shall mean ninety days from the date the department receives the
14 complaint. If the repairs are not completed within such time, the home-
15 owner shall be entitled to have all repairs done by a licensed contrac-
16 tor and to receive a property tax credit for the reasonable cost of
17 completing such repair.
18 § 2. This act shall take effect immediately.
