  TITLE OF BILL: An act to amend the public health law and the social services law, in relation to allowing personal caregivers to visit residents of adult care facilities   PURPOSE OR GENERAL IDEA OF BILL: To allow personal caregiving visitors in adult care facilities at all times.   SUMMARY OF PROVISIONS: Section 1: amends subdivision 2 of section 2801-h of the public health law, as amended by chapter 108 of the laws of 2021, to remove language limiting personal caregiving to times when public health emergencies are declared. Section 2: amends subdivision 2 of section 461-u of the social services law, as amended by chapter 107 of the laws of 2021, to remove language limiting personal caregiving to times when public health emergencies are declared.   JUSTIFICATION: The COVID-19 pandemic has kept nursing home and adult care facility residents apart from their loved ones since March 2020. The legislature previously passed legislation enacting a system of personal caregiving that seeks to end isolation and allow for even during a public health emergency. With the end of the declared public health emergency in summer 2021, the personal caregiving policies went out of effect. This legislation ends this on/off approach to policymaking by ensuring that personal caregiving visitation will always be available to nursing home and adult care facility residents and their families.   LEGISLATIVE HISTORY: A8370 of 2021-22: referred to Health   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: Immediately

Subdivision 2 of section 2801-h of the public health law, 2 as amended by chapter 108 of the laws of 2021, is amended to read as 3 follows: 4 2. [During a public health emergency declared under section twenty-5four or section twenty-eight of the executive law personal] Personal 6 caregiving visitors may visit residents of nursing homes, in compliance 7 with federal law and regulations and state regulations made under this 8 section. Nursing homes shall admit any personal caregiving visitor who 9 is in compliance with applicable requirements under this section. 10 § 2. Subdivision 2 of section 461-u of the social services law, as 11 amended by chapter 108 of the laws of 2021, is amended to read as 12 follows: 13 2. [During a public health emergency declared under section twenty-14four or section twenty-eight of the executive law personal] Personal 15 caregiving visitors may visit residents of adult care facilities, in 16 compliance with federal law and regulations and state regulations made 17 under this section.
