  TITLE OF BILL: An act to amend the public authorities law, in relation to the composi- tion of the Niagara Frontier transportation authority   PURPOSE OR GENERAL IDEA OF BILL: Relates to adding two trustees to the power authority to represent Niagara County and St. Lawrence County.   SUMMARY OF SPECIFIC PROVISIONS: Section 1. - Increases the number of trustees to the Power Authority from seven to nine. The eighth and ninth trustees shall be appointed by the governor, by and with the advice and consent of the Senate and shall be residents of Niagara County and St. Lawrence County, respectively. Changes the official title of the trustee chosen as chairman of the power authority from chairman to chairperson. Section 2. - Effective Date Immediately   JUSTIFICATION: The two named counties are home to the largest power producing plants owned by the New York State Power Authority and it would be proper for them to have representation on the board of trustees.   PRIOR LEGISLATIVE HISTORY: A.7646 of 2021-22 A.6562 of 2019-20   FISCAL IMPLICATIONS: To be determined.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as chapter 801 of the laws of 2022, takes effect.

        AN ACT to amend the public authorities law, in relation to the  composi-
          tion of the Niagara Frontier transportation authority
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (a) of subdivision 1 of  section  1299-c  of  the
     2  public  authorities  law, as amended by chapter 801 of the laws of 2022,
     3  is amended to read as follows:
     4    (a) There is  hereby  created  the  "Niagara  Frontier  transportation
     5  authority."  The authority shall be a body corporate and politic consti-
     6  tuting a public benefit corporation. The authority shall  consist  of  a
     7  chairman,  [ten]  twelve  voting  members  and shall have one non-voting
     8  member as described in paragraph (b) of this  subdivision  appointed  by
     9  the  governor  by  and  with  the  advice and consent of the senate. The
    10  chairman and all members shall be residents  of  the  district.  Of  the
    11  [ten]  twelve  voting  members  other  than  the  chairman, one shall be
    12  appointed upon the written recommendation of the Erie county  executive,
    13  one shall be appointed upon the written recommendation of the Erie coun-
    14  ty  legislature,  two shall be appointed upon the written recommendation
    15  of the Niagara county legislature and at least one shall  be  a  transit
    16  dependent  individual.  The  chairman  and  each of the members shall be
    17  appointed for a term of eight years, provided however, that the chairman
    18  first appointed shall serve for a term ending June  thirtieth,  nineteen
    19  hundred  seventy-three,  and of the eight other members first appointed,
    20  one shall serve for a  term  ending  June  thirtieth,  nineteen  hundred
    21  sixty-eight,  two shall serve for a term ending June thirtieth, nineteen
    22  hundred sixty-nine, one shall serve for a term  ending  June  thirtieth,
    23  nineteen hundred seventy, two shall serve for a term ending June thirti-
    24  eth,  nineteen  hundred  seventy-one,  one shall serve for a term ending
    25  June thirtieth, nineteen hundred seventy-two and one shall serve  for  a

     1  term  ending June thirtieth, nineteen hundred seventy-three. The term of
     2  one of the members appointed to memberships first created by  law  after
     3  April  first,  nineteen  hundred sixty-nine shall end on June thirtieth,
     4  nineteen  hundred  seventy-four,  and  the term of the other such member
     5  shall end on June thirtieth, nineteen  hundred  seventy-five.  Following
     6  the  expiration  of any term ending on or after June thirtieth, nineteen
     7  hundred eighty-seven, each member shall be appointed for a term of  five
     8  years beginning on the day after the expiration date of such prior term;
     9  provided,  however, that the term of the member first appointed upon the
    10  written recommendation of the Erie county executive and the term of  the
    11  member first appointed upon the written recommendation of the Erie coun-
    12  ty  legislature  shall  be for a term ending on June thirtieth, nineteen
    13  hundred ninety-six.
    14    § 2. This act shall take effect on the  same  date  and  in  the  same
    15  manner as chapter 801 of the laws of 2022, takes effect.
