  TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a place of worship   PURPOSE: This bill will allow Nettie's Restaurant in Queens, NY to sell alcoholic beverages   SUMMARY OF PROVISIONS: Adds paragraph e-15 to the alcoholic beverage control law to grant a liquor licenses to Nettie's Restaurant in Queens, NY, which is currently within 200 ft. of a place of worship, thus barring it from alcohol sales per NYS alcoholic beverage control law   JUSTIFICATION: Nettie's Restaurant has been going strong for a number of years absent the sale of alcoholic beverages. This bill will allow them to sell alco- hol. The church that is within 200 feet of the establishment has submit- ted a letter to the State Liquor Authority stating they would be grate- ful if the state granted such license to Nettie's. In light of their statement and the continued good nature of the Nettie's business in the community, they require a legislative bill to authorize liquor sales. This bill will enable them to do that.   LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This law will take effect immediately.

        AN ACT to amend the alcoholic beverage control law, in  relation  to  an
          exemption  for  certain property from the prohibition of alcohol sales
          within a certain distance from a place of worship

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-15)  to  read  as
     3  follows:
     4    (e-15)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a premises which shall be within two hundred feet of a
     7  building occupied exclusively as a school, church,  synagogue  or  other
     8  place  of worship, provided such premises constitutes a premises for the
     9  sale of food or beverages at retail  for  consumption  on  the  premises
    10  located wholly within the boundaries of the Borough of Queens, county of
    11  Queens, City and State of New York, bounded and described as follows:
    12    AS TO LOT 3
    13    ALL that certain plot, piece or parcel of land, with the buildings and
    14  improvements  thereon  erected,  situate, lying and being in the Borough
    15  and County of Queens, City and State of New York, bounded and  described
    16  as follows:
    17    BEGINNING  at  a  point on the Northerly side of Hempstead Avenue, 100
    18  feet wide, distant 40.01 feet Easterly from the  corner  formed  by  the
    19  intersection  of the Northerly side of Hempstead Avenue and the Easterly
    20  side of 220th Street;
    21    RUNNING THENCE Northerly parallel with 220th Street and  part  of  the
    22  distance through a party wall, 100.28 feet;
    23    THENCE  Easterly  at  right angles to the last mentioned course, 19.58
    24  feet;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    THENCE Southerly parallel with 220th Street and part of  the  distance
     2  through  a  party  wall  100.68  feet to the Northerly side of Hempstead
     3  Avenue;
     4    THENCE  Westerly  along  the Northerly side of Hempstead Avenue, 19.58
     5  feet to the point or place of BEGINNING.
     6    Being and intended to be the same premises described in  a  deed  from
     7  Leroy  Brown  and Vernetta Brown to Dannie Lomas dated November 30, 2007
     8  and recorded on December 5, 2007 in the  City  Registers  Queens  County
     9  City Register File Number 2007000600283.
    10    § 2. This act shall take effect immediately.
