TITLE OF BILL:
An act to amend the New York city charter, in relation to discretionary
purchasing thresholds for certified minority and women-owned business
enterprises
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would authorize the City of New York and its respective agen-
cies to increase the discretionary award amount of non-competitive
contracts from $1,000,000 to $1,500,000.
 
SUMMARY OF PROVISIONS:
Section 1 amends Paragraph 1 of subdivision i of section 311 of the New
York city charter, as amended by chapter 569 of the laws of 2022 to
raise the MWBE procurement discretionary threshold from $1,000,000 to
$1,500,000.
Section 2 is the effective date.
 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE):
The A-print only includes original bill section 3 and adds a new section
2.
 
JUSTIFICATION:
Government contracting with Minority and Women-Owned Business Enter-
prises is an important tool to provide economic empowerment to members
of historically excluded groups and their communities. This bill will
facilitate more MWBE contracting by raising the procurement discretion-
ary threshold for the City of New York.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
None.  
EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend the New York city charter, in relation to discretionary
purchasing thresholds for certified minority and women-owned busi-
ness enterprises
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 1 of subdivision i of section 311 of the New York
2 city charter, as amended by chapter 569 of the laws of 2022, is amended
3 to read as follows:
4 1. agencies may make procurements of goods, services and construction
5 for amounts not exceeding one million five hundred thousand dollars from
6 businesses certified as minority or women-owned business enterprises
7 pursuant to section thirteen hundred four of the charter without a
8 formal competitive process.
9 § 2. This act shall take effect immediately.
