  TITLE OF BILL: An act to amend the public authorities law, in relation to requiring at least one electric charging station for every ten thousand New York state residents   PURPOSE OR GENERAL IDEA OF BILL: To establish a minimum number of publicly available electric vehicle charging stations per residents.   SUMMARY OF PROVISIONS: Section 1 amends subdivision 9-a of section 1005 of the public authori- ties law to mandate that the New York Power Authority be responsible for the installation and operation of level three fast electric vehicle charging stations per every 10,000 residents in the state. Also, adds a prevailing wage requirement. Section 2 provides the effective date   JUSTIFICATION: Consumer surveys have shown that one of the biggest barriers to the adoption of electric vehicles is inadequate charging infrastructure. With overreliance on fossil fuels worsening our climate crisis, electric vehicles must increasingly play a role in our daily lives. The New York Power Authority has an existing statutory goal to install publicly available electric vehicle chargers. This legislation attaches a minimum number of fast chagrining stations for residents to ensure that the resulting infrastructure truly increases the viability of electric vehi- cle ownership in New York.   PRIOR LEGISLATIVE HISTORY:   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: Immediately after becoming law.

        AN ACT to amend the public authorities law, in relation to requiring  at
          least  one  electric  charging station for every ten thousand New York
          state residents
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivision 9-a of section 1005 of the public authorities
     2  law, as added by section 1 of part KK of chapter 58 of the laws of 2019,
     3  is amended to read as follows:
     4    9-a. [As deemed feasible and advisable by the trustees, to] To design,
     5  finance, develop, construct, install, lease, operate and maintain  elec-
     6  tric  vehicle  charging  stations  throughout  the  state for use by the
     7  public, with at least one level three fast charging  station  for  every
     8  ten  thousand New York state residents. The construction and development
     9  of such  electric  vehicle  charging  stations  shall  comply  with  the
    10  provisions of article eight of the labor law, including the payment of a
    11  wage  of  not  less  than the prevailing wage in the locality where such
    12  electric vehicle charging station is located. The authority shall  annu-
    13  ally  post  on  their  website  a  report on those activities undertaken
    14  pursuant to this subdivision, including but not limited  to:  the  total
    15  number  of  electric  vehicle charging stations in operation pursuant to
    16  such authorization, the locations of such  charging  stations,  and  the
    17  total costs to the authority associated with such activities.
    18    § 2. This act shall take effect immediately.
