  TITLE OF BILL: An act to amend the public health law, in relation to providing informa- tion on where a list of violations and other actions taken against the facility can be found   PURPOSE: The purpose of this bill is to increase transparency regarding a resi- dential health care facility's compliance with laws and regulations.   SUMMARY OF SPECIFIC PROVISIONS: This bill would require residential health care facilities to provide residents and their families with a document that includes information on how potential residents and families can find information on complaints, citations, inspections, enforcement actions, and penalties taken against the facility.   JUSTIFICATION: The legislature held public hearings on the impact of COVID-19 on resi- dential health care facilities, which revealed that many residents and their families are not aware of the how to access information maintained by the Department of Health on residential health care facilities and their compliance with applicable laws and regulations. This bill would increase transparency by requiring residential health care facilities to provide residents and their families with information that guides them to where to locate information online that will be critical to families seeking to make informed decisions about appropriate placement in a residential health care facility.   LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: Sixty days succeeding enactment.

        AN ACT to amend the public health law, in relation to providing informa-
          tion on where a list of violations and other actions taken against the
          facility can be found
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 2803 of the public health law is amended by adding
     2  a new subdivision 13 to read as follows:
     3    13. The commissioner shall require each residential health care facil-
     4  ity to provide residents and their families with a separate document, as
     5  part of an intake application, in no less than twelve-point  font,  that
     6  includes  information  on  how  a  potential  resident  and their family
     7  members can look  up  complaints,  citations,  inspections,  enforcement
     8  actions,  and  penalties  taken  against  the facility including the web
     9  address for the New York state nursing home  profiles  website  that  is
    10  maintained  by the department and the nursing home compare website main-
    11  tained by the United States department of health and human services,  if
    12  applicable.
    13    §  2.  This  act  shall take effect on the sixtieth day after it shall
    14  have become a law.
