NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A3467

SPONSOR: Pretlow
TITLE OF BILL: An act to amend the tax law, in relation to requiring security devices on lottery machines to prevent use by minors   PURPOSE: The purpose of this bill is to further ensure that people who buy lottery tickets are of the appropriate age.   SUMMARY OF PROVISIONS: Amends section 1610 of the tax law to help ensure that underaged people are not allowed to purchase lottery tickets.   JUSTIFICATION: Currently, self-serve lottery vending machines are allowed under the law. However, in some cases, the machines are not closely supervised and underaged people are buying lottery tickets illegally. This bill would require the installation and maintenance of a lockout device on all lottery vending machines, requiring the merchant to activate the lottery machine before each purchase. In doing so, the merchant will be able to ascertain whether the customer is of legal age to play the lottery. Vending machines that dispense lottery tickets are sometimes not care- fully watched to prevent underage players. This bill would require that the person selling the lottery tickets activate the machine in Order for a person to buy tickets from the vending machine.   LEGISLATIVE HISTORY: 2022 01/05/22 A3769 referred to ways and means 2019-2020 A4597 referred to"ways& Means 2017/2018 A1822 referred to ways & means 2015-2016 A2653 referred to ways& means 2013-14 A3711 referred to ways & means S5099 referred to Racing, Gaming 2009-10 S.3029; 2007-08, S.1333; 2005-06, S.915; 2003-04, S.1775; 2001-02, S.3293; 1999-00, S.2021; 1997-98, S.3770, A.5871   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This act shall take effect 90 day after it shall have become a law.
