BILL NUMBER: A9517
SPONSOR: Anderson

TITLE OF BILL:
An act to amend the penal law, in relation to criminal possession of a
ghost gun; and repealing certain provisions of such law relating thereto

PURPOSE OR GENERAL IDEA OF BILL::
This legislation makes possession of a ghost gun with the intent to
sell, manufacture and/or distribute criminal possession of a weapon in
the second degree

SUMMARY OF SPECIFIC PROVISIONS::
Section 1: Amends section 265.03 of the penal law criminal possession of
a weapon in the second degree to include the possession of ghost guns
Section 2: Repeals Subdivision 9 of 265.01
Section 3: This act shall take effect immediately

JUSTIFICATION:
Ghost guns are typically homemade firearms that can be assembled from
kits or 3D-printed parts, often without serial numbers or other identi-
fying markings.Ghost guns are often unserialized, making them difficult
or impossible to trace. This lack of traceability poses a significant
challenge for law enforcement in investigating crimes involving these
weapons.
The unregulated production and distribution of ghost guns can potential-
ly contribute to an increase in gun violence and criminal activities.
These firearms may be more easily obtained by individuals who are
prohibited from owning guns or who wish to evade background checks.Ghost
guns exploit gaps in existing gun control laws and regulations. By
circumventing background checks and other regulatory processes, these
firearms can end up in the hands of individuals who would otherwise be
denied access to conventional firearms.
