AN ACT to amend the insurance law, in relation to three-dimensional
mammograms
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 3 of subsection (t) of section 1121 of the insur-
2 ance law, as added by chapter 639 of the laws of 1996, is amended to
3 read as follows:
4 (3) Mammography screening including tomosynthesis imaging.
5 § 2. Subparagraphs (C) and (F) of paragraph 11 of subsection (i) of
6 section 3216 of the insurance law, subparagraph (C) as amended by chap-
7 ter 219 of the laws of 2011 and subparagraph (F) as added by chapter 74
8 of the laws of 2016, are amended to read as follows:
9 (C) For purposes of subparagraphs (A) and (B) of this paragraph,
10 mammography screening means an X-ray examination of the breast using
11 dedicated equipment, including X-ray tube, filter, compression device,
12 screens, films and cassettes, with an average glandular radiation dose
13 less than 0.5 rem per view per breast, or tomosynthesis imaging.
14 (F) Screening and diagnostic imaging for the detection of breast
15 cancer, including diagnostic mammograms, breast ultrasounds, [or]
16 magnetic resonance imaging, or tomosynthesis imaging covered under the
17 policy shall not be subject to annual deductibles or coinsurance.
18 § 3. Subparagraphs (C) and (F) of paragraph 11 of subsection (l) of
19 section 3221 of the insurance law, subparagraph (C) as amended by chap-
20 ter 219 of the laws of 2011 and subparagraph (F) as added by chapter 74
21 of the laws of 2016, are amended to read as follows:
22 (C) For purposes of subparagraphs (A) and (B) of this paragraph,
23 mammography screening means an X-ray examination of the breast using
24 dedicated equipment, including X-ray tube, filter, compression device,

7 § 4. Paragraphs 2 and 5 of subsection (p) of section 4303 of the
8 insurance law, paragraph 2 as amended by chapter 219 of the laws of 2011
9 and paragraph 5 as added by chapter 74 of the laws of 2016, are amended
10 to read as follows:
11 (2) For purposes of paragraph one of this subsection, mammography
12 screening means an X-ray examination of the breast using dedicated
13 equipment, including X-ray tube, filter, compression device, screens,
14 films and cassettes, with an average glandular radiation dose less than
15 0.5 rem per view per breast, or tomosynthesis imaging.
16 (5) Screening and diagnostic imaging for the detection of breast
17 cancer, including diagnostic mammograms, breast ultrasounds, [or]
18 magnetic resonance imaging, or tomosynthesis imaging covered under the
19 contract shall not be subject to annual deductibles or coinsurance.
20 § 5. This act shall take effect immediately and shall apply to poli-
21 cies and contracts issued, renewed, modified or amended on or after
22 January 1, 2018.
