        AN  ACT  to  amend  the administrative code of the city of New York, the
          vehicle and traffic law and the state  finance  law,  in  relation  to
          funding the animal population control fund

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 17-812 of the administrative code of  the  city  of
     2  New York is amended by adding a new subdivision 4 to read as follows:
     3    4.  An amount not to exceed fifteen percent of the balance of the fund
     4  at the beginning of each fiscal year shall be available for the purposes
     5  of implementation and promotion of the animal population control program
     6  established pursuant to section 17-811 of this chapter.  Such  promotion
     7  shall  include  educating  the public about the benefits associated with
     8  spaying and neutering and where to obtain low-cost spaying and neutering
     9  services.
    10    § 2. Subdivision 2 of section 404-p of the vehicle and traffic law, as
    11  amended by chapter 577 of the laws  of  2007,  is  amended  to  read  as
    12  follows:
    13    2.  A distinctive Animal Population Control Fund plate issued pursuant
    14  to this section shall be issued in  the  same  manner  as  other  number
    15  plates  upon  the  payment of the regular registration fee prescribed by
    16  section four hundred one of this  article  provided,  however,  that  an
    17  additional annual service charge of twenty-five dollars shall be charged
    18  for such plate. All monies received as annual service charges under this
    19  section  shall  be  deposited  to  the  credit  of the animal population
    20  control fund established pursuant  to  section  ninety-seven-xx  of  the
    21  state  finance  law,  and  shall  be  used for animal population control
    22  programs undertaken pursuant to section one hundred seventeen-a  of  the
    23  agriculture  and  markets law, except that all monies received as annual
    24  service charges under this section from New York city residents shall be

     1  deposited to the credit of the animal population  control  fund  created
     2  pursuant to section 17-812 of the administrative code of the city of New
     3  York  and shall be used for the animal population control program under-
     4  taken  pursuant to section 17-811 of the administrative code of the city
     5  of New York.
     6    § 3. Section 97-xx of the state finance law is amended by adding a new
     7  subdivision 5 to read as follows:
     8    5. Notwithstanding the provisions of this section, all monies deposit-
     9  ed, credited to or transferred from any fund or  source  to  the  animal
    10  population  control fund established pursuant to this section, including
    11  but not  limited  to,  sections  three  hundred  seventy-seven-a,  three
    12  hundred  seventy-nine,  ninety-six-e and ninety-six-h of the agriculture
    13  and markets law, section three hundred  ninety-nine-aa  of  the  general
    14  business law, and section four hundred four-p of the vehicle and traffic
    15  law,  that emanate from any resident or source in New York city shall be
    16  forwarded by the state comptroller to the animal population control fund
    17  established pursuant to section 17-812 of the administrative code of the
    18  city of New York.
    19    § 4. This act shall take effect on the ninetieth day  after  it  shall
    20  have become a law.
