AN ACT to amend the correction law, in relation to preventing sexually
transmitted diseases, hepatitis C and HIV among correctional employees
and inmates
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The correction law is amended by adding a new section 141-a
2 to read as follows:
3 § 141-a. Sexually transmitted diseases, hepatitis C and HIV;
4 prevention. 1. The commissioner shall develop and implement programs in
5 every correctional facility to prevent the spread of sexually transmit-
6 ted diseases, hepatitis C and human immunodeficiency virus infection,
7 for employees and inmates, including education, outreach, harm
8 reduction, offering testing, and availability of prophylactic devices.
9 2. In developing programs for the prevention of sexually transmitted
10 diseases, hepatitis C and human immunodeficiency virus infection, the
11 commissioner shall consult with the commissioner of health to identify
12 and select curricula that are likely to be effective in reducing trans-
13 mission of infectious diseases within correctional facilities and to
14 contacts of prisoners upon their release.
15 3. The programs required by subdivision one of this section may
16 include peer education and use of non-department personnel, and shall be
17 in the language of the targeted population, shall take into account the
18 literacy level of the targeted population, and shall be culturally
19 sensitive to the social and cultural needs of the targeted population.
20 § 2. This act shall take effect immediately.
