        AN  ACT to amend the executive law, in relation to prohibiting discrimi-

          nation against persons who perform volunteer services
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 292 of the executive law is amended by adding a new
     2  subdivision 35 to read as follows:
     3    35.  The  term  "volunteer  services" means services performed without
     4  remuneration for any organization, association,  school,  civic  league,
     5  state  or local governmental agency, fund, foundation, institution, home
     6  or agency, organized and operated exclusively for charitable,  scientif-
     7  ic,  health, aesthetic, artistic, recreational, public safety, literary,
     8  eleemosynary or educational purposes or  for  the  promotion  of  social
     9  welfare or the purpose of which is to promote the informed participation

    10  of citizens in government.
    11    §  2.  Section  296  of  the  executive law is amended by adding a new
    12  subdivision 22 to read as follows:
    13    22. It shall be an unlawful discriminatory  practice  for  any  person
    14  acting on behalf of any organization, association, school, civic league,
    15  state  or local governmental agency, fund, foundation, institution, home
    16  or agency, organized and operated exclusively for charitable,  scientif-
    17  ic,  health, aesthetic, artistic, recreational, public safety, literary,
    18  eleemosynary or educational purposes or  for  the  promotion  of  social
    19  welfare or the purpose of which is to promote the informed participation
    20  of  citizens  in  government to discriminate in the terms, conditions or

    21  privileges of such organization against any person who  performs  or  is
    22  seeking  to  perform  volunteer  services therefor on the basis of race,
    23  creed, color, national origin, sex, age, disability or marital status.
    24    § 3. This act shall take effect immediately.
