        AN  ACT  to  amend part C of chapter 58 of the laws of 2005, relating to
          authorizing reimbursements for expenditures made by or  on  behalf  of
          social services districts for medical assistance for needy persons and
          the administration thereof, and to amend the general municipal law, in
          relation  to  calculating  social services district medical assistance
          expenditure amounts
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision (c-1) of section 1 of part C of chapter 58 of
     2  the laws of 2005, relating to authorizing  reimbursements  for  expendi-
     3  tures  made  by  or  on  behalf of social services districts for medical
     4  assistance for needy persons and the administration thereof, as added by
     5  section 1 of part F of chapter 56 of the laws of  2012,  is  amended  to
     6  read as follows:
     7    (c-1)  Notwithstanding  any  provisions  of  subdivision  (c)  of this
     8  section to the contrary, effective April 1, 2013, for the period January
     9  1, 2013 through December 31, 2013 and for each calendar year thereafter,
    10  the medical  assistance  expenditure  amount  for  the  social  services
    11  district for such period shall be [equal to] the greater of (i) zero; or
    12  (ii)  the previous calendar year's medical assistance expenditure amount
    13  minus five percent of the medical assistance expenditure amount for  the
    14  period January 1, 2018 through December 31, 2018, except that:

     1    (1)  for  the  period  January  1, 2013 through December 31, 2013, the
     2  previous calendar year medical assistance  expenditure  amount  will  be
     3  increased by 2%;
     4    (2)  for  the  period  January  1, 2014 through December 31, 2014, the
     5  previous calendar year medical assistance  expenditure  amount  will  be
     6  increased by 1%; and
     7    (3)  for  the  period  January  1, 2019 through December 31, 2019, the
     8  previous calendar year medical assistance  expenditure  amount  will  be
     9  unchanged.
    10    §  2.  Paragraph  (c)  of  subdivision 3 of section 3-c of the general
    11  municipal law is amended by adding a new subparagraph (viii) to read  as
    12  follows:
    13    (viii)  Subtract  the  amount  that  the  prior  fiscal year's medical
    14  assistance expenditure amount exceeds the current fiscal year's  medical
    15  assistance  expenditure  amount,  provided that this shall only apply to
    16  counties and shall only apply to fiscal years that begin after two thou-
    17  sand eighteen.
    18    § 3. This act shall take effect immediately, provided,  however,  that
    19  the  amendments  to  section  3-c  of  the general municipal law made by
    20  section two of this act shall not affect the repeal of such section  and
    21  shall be deemed repealed therewith.
