AN ACT requiring reporting on residential customer savings realized
through the use of time-of-use tariffs and smart meters
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. On or before December 1, 2020, the New York state public
2 service commission, in consultation with the New York state energy
3 research and development authority, the Long Island power authority, and
4 the New York power authority shall publish an up to date report on resi-
5 dential customer savings realized through the use of time-of-use tariffs
6 and smart meters. The report on residential customer savings shall
7 include, at a minimum, the following:
8 1. A comprehensive summary, for New York state and for each utility,
9 of:
10 (a) the total number of customers enrolled in time-of-use tariffs;
11 (b) the total number of smart meters installed;
12 (c) the total cost, including capital expenditures and operating
13 expenses, actually incurred or spent on the use of smart meters, includ-
14 ing the allocation of costs between utilities, all ratepayers, and smart
15 meter customers;
16 (d) the total savings realized through time-of-use tariffs and smart
17 meters; and
18 (e) outcomes associated with time-of-use tariffs and smart meters,
19 including, at a minimum, the following:
20 i. changes in carbon emissions;
21 ii. changes and/or shifts in customer electricity usage;
22 iii. changes in the frequency and/or duration of electricity outages;
23 and
24 iv. any other outcomes the commission deems relevant;

1 2. An analysis of each utility's time variant pricing tariffs and
2 customer bill savings realized through the use of such tariffs, includ-
3 ing, but not limited to time-of-use;
4 3. An analysis and summary of each utility's best practices, proce-
5 dures, and policies for providing smart meter and time-of-use customers
6 with reasonable access to their own data, protecting the privacy and
7 confidentiality of such data, and any other information the commission
8 deems relevant to customer data protection;
9 4. A forecast of smart meter installations and penetration by the year
10 2024; and
11 5. A forecast of customer enrollment in time-of-use tariffs by the
12 year 2024.
13 § 2. For purposes of this act, the term:
14 1. "Smart meter" shall mean a meter that is capable of recording
15 consumption of electric energy and communicating such information
16 utilizing two-way communication between the meter and the utility; and
17 2. "Utility" shall include electric corporations and combination gas
18 and electric corporations having annual gross revenues in excess of two
19 hundred million dollars.
20 § 3. A copy of the report required by section one of this act shall be
21 submitted to the temporary president of the senate, the speaker of the
22 assembly, the chairperson of the senate standing committee on energy and
23 telecommunications and the chairperson of the assembly standing commit-
24 tee on energy.
25 § 4. This act shall take effect immediately.
