        AN ACT to amend the public health law, in relation to periodic  diagnos-
          tic and treatment center inspection

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 2801 of the public health law is amended by  adding
     2  a new subdivision 11 to read as follows:
     3    11. "Diagnostic and treatment center" means any hospital as defined by
     4  subdivision  one of this section operating as a diagnostic and treatment
     5  center authorized to provide ambulatory surgical services, including but
     6  not limited to diagnostic and treatment centers regulated by Part  seven
     7  hundred  fifty-five  or Part seven hundred fifty-six of Title ten of the
     8  New York Code of Rules and Regulations.
     9    § 2. The public health law is amended by adding a new section 2828  to
    10  read as follows:

     1    §  2828.  Powers  and  duties of the commissioner. 1. The commissioner
     2  shall promulgate rules and regulations to carry out  the  provisions  of
     3  this  article,  including,  but not limited to, regulations establishing
     4  standards for cleanliness, hygiene, and safety.
     5    2.  The  department,  under  the  direction of the commissioner, shall
     6  inspect each diagnostic and treatment center not less  than  biennially.
     7  The  commissioner  may appoint and designate, from time to time, persons
     8  to make the inspections authorized by this article.
     9    3. The commissioner shall create  a  biennial  report  indicating  the
    10  results  of  all individual inspections and deliver a copy to the assem-
    11  bly, the senate, and the governor.
    12    4. The commissioner may by regulation authorize any county or  munici-
    13  pal department of health to administer this section within its jurisdic-
    14  tion.
    15    5. Provisions of this section shall not apply to facilities accredited
    16  by the joint commission on accreditation of healthcare organizations.
    17    § 3. This act shall take effect immediately.
