        AN  ACT  to  amend  the elder law, in relation to establishing a locator
          technology advisory council
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  elder  law is amended by adding a new section 224 to
     2  read as follows:
     3    § 224. Locator technology advisory council. 1. There is hereby  estab-
     4  lished in the office a locator technology advisory council to advise the
     5  office  on  locator technology, including Global Positioning technology,
     6  for use by persons afflicted by  Alzheimer's  Disease,  dementia  and/or
     7  other afflictions, or by their families or caretakers, who would benefit
     8  from  the  appropriate  use  of  such  technologies.  Such council shall
     9  consist of eight persons appointed by the director of whom four shall be

    10  members of advocacy groups for individuals with Alzheimer's  Disease  or
    11  dementia  or  for  seniors  in this state, and four shall be individuals
    12  with at least five years experience in the technology of locator systems
    13  and/or global positioning system technology. The members of the advisory
    14  council shall receive no compensation for  their  services  pursuant  to
    15  this  section,  but  shall be entitled to reimbursement for their actual
    16  and  necessary  traveling  and  other  expenses  incurred  by  them   in
    17  connection with the performance of their duties under this section.
    18    2.  The  council  shall,  after  investigation and upon majority vote,
    19  forward to the director recommendations  on  locator  technology  models

    20  available  for  purchase  by  individuals  that in the estimation of the
    21  council would benefit individuals and families of  individuals  who  are
    22  afflicted  by Alzheimer's Disease, dementia and/or other afflictions. If
    23  the director shall agree with the recommendations, he or she may promul-

     1  gate such list as a regulation of  the  office.    Such  list  shall  be
     2  updated at least once each year, on or before November first.
     3    §  2.  This  act  shall  take  effect  immediately; provided, that the

     4  members of the locator technology advisory council established  pursuant
     5  to  section  one  of  this  act shall be appointed within 90 days of the
     6  effective date of this act.
