        AN  ACT  to amend the general business law, in relation to requiring gas
          stations to maintain a backup generator to operate gas  pumps  in  the
          event of loss of electricity

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The general business law is amended by adding a new section
     2  399-eee to read as follows:
     3    § 399-eee. Placement of backup generators at gas stations. 1.    Every
     4  retail  gas station located within this state shall be required to main-
     5  tain a backup generator capable of operating all gas pumps  situated  on
     6  the property for a period of no less than forty-eight hours in the event
     7  that the retail gas station loses its main source of electricity.
     8    2.  For  purposes  of  this section, "retail gas station" shall mean a
     9  filling station where gasoline is stored primarily for sale by  delivery
    10  directly  into  the  ordinary  fuel  tank connected with the engine of a
    11  motor vehicle or vessel to be consumed in the operation  of  such  motor
    12  vehicle or vessel.
    13    § 2. This act shall take effect on the one hundred eightieth day after
    14  it shall have become a law.
