Go to top STATE OF NEW YORK ________________________________________________________________________ 4289 2019-2020 Regular Sessions IN ASSEMBLY February 4, 2019 ___________ Introduced by M. of A. WALLACE -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to requiring recess every day for elementary school students The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 817 to 2 read as follows: 3 § 817. Recess. Each school shall regularly schedule a time of a 4 reasonable length within each school day for each full day pupil attend- 5 ing pre-kindergarten through grade six to engage in physical activity in 6 an unstructured free play session monitored by a staff of school employ- 7 ees or volunteers. 8 § 2. This act shall take effect on the first of July after it shall 9 have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD08323-01-9
