AN ACT to amend the education law, in relation to moving the date of the
election of members of the board of education of the Buffalo city
school district to the third Tuesday in May
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph p of subdivision 10 of section 2553 of the educa-
2 tion law, as amended by chapter 561 of the laws of 2019, is amended to
3 read as follows:
4 p. The election of members of the board of education of the school
5 district of the city of Buffalo shall take place on the [first] third
6 Tuesday [after the first Monday] in [November] May in each year in which
7 an incumbent's term expires; provided, however that such election shall
8 be held on the second Tuesday in May if the commissioner, at the request
9 of the school board, certifies no later than March first that such
10 election would conflict with religious observances. Such election shall
11 be conducted by the board of elections of the county of Erie in the same
12 manner as other elections are conducted by it. The results of such
13 elections, after canvassing, shall be certified and reported by the
14 board of elections to the board of education of such city. The clerk or
15 other appropriate officer of the board of education shall within twen-
16 ty-four hours after receipt of such certification by the board of
17 elections serve a written notice either personally or by mail upon each
18 person declared to be elected as a member of the board of education
19 informing him of his election and the length of his term.
20 § 2. This act shall take effect immediately and shall apply to
21 elections conducted on and after May 1, 2020.
