        Introduced  by  M.  of  A.  LALOR, DeSTEFANO, McDONOUGH -- read once and
          referred to the Committee on Transportation
 
        AN ACT to amend the highway  law,  in  relation  to  permitting  munici-
          palities  to  use  highway assistance payments for capitol projects or
          maintenance

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 10-c of the highway law is amended by adding a new
     2  subdivision 9 to read as follows:
     3    9. Notwithstanding the other provisions of  this  section,  a  munici-
     4  pality  shall have the sole discretion to use funding distributed pursu-
     5  ant to this section for either capital projects or  routine  maintenance
     6  projects in the amount such municipality deems appropriate.
     7    § 2. This act shall take effect immediately.
