        AN  ACT  to amend the education law, in relation to allowing a principal
          employed by a district to make a  written  request  to  the  board  of
          education  for  an  extended  leave  of  absence to teach at a charter
          school
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  3  of  section 2854 of the education law, is
     2  amended by adding a new paragraph (d-1) to read as follows:
     3    (d-1) In a school district of  a  city  having  a  population  of  one

     4  million or more, a principal employed by such school district may make a
     5  written  request  to  the  board  of  education for an extended leave of
     6  absence to serve as a principal of a charter school. Approval for such a
     7  leave of absence for a period of three years or less shall not be unrea-
     8  sonably withheld.  If such approval is granted to  a  principal  by  the
     9  school district, the principal may return to serve as a principal in the
    10  school  district  during  such  period  of leave without the loss of any
    11  right of certification, retirement,  seniority,  salary  status  or  any
    12  other benefit provided by law or by collective bargaining agreement.  If
    13  an  appropriate  position  is unavailable, the principal's name shall be

    14  placed on a preferred eligible list of candidates for appointment  to  a
    15  vacancy  that  may  thereafter occur in an office or position similar to
    16  the one such principal filled in such school district immediately  prior
    17  to the leave of service.
    18    § 2. This act shall take effect immediately.
