        Introduced  by  M. of A. CRESPO, ARROYO, DAVILA, DILAN, PICHARDO, RAMOS,
          RIVERA, RODRIGUEZ, ROZIC, SOLAGES -- read once  and  referred  to  the
          Committee on Health
 
        AN ACT to amend the social services law, in relation to establishing the
          department of health as the agency to provide proof of Medicaid eligi-
          bility  when  requested by a recipient or his or her designated repre-
          sentative
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  366-a  of  the social services law is amended by
     2  adding a new subdivision 3-a to read as follows:
     3    3-a. The department of health shall respond to a request within thirty
     4  days and it shall be the single state agency required to  provide  proof
     5  of   eligibility  on  official  department  of  health  letterhead  when
     6  requested by a  recipient  or  his  or  her  designated  representative,
     7  including,  but not limited to, legal counsel, legal guardian, or attor-
     8  ney-in-fact under a power of attorney.
     9    § 2. This act shall take effect immediately.
