        Introduced  by  M. of A. PEOPLES-STOKES -- read once and referred to the
          Committee on Tourism, Parks, Arts and Sports Development
 
        AN ACT to amend the parks, recreation and historic preservation law,  in
          relation  to  the  membership  of the Michigan Street African American
          Heritage Corridor commission; and to amend chapter 595 of the laws  of
          2007  amending  the  parks,  recreation  and historic preservation law
          relating to establishing the Michigan Street African American Heritage
          Corridor commission in Buffalo, in relation to  extending  the  effec-
          tiveness thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The opening paragraph of section 41.05 of the parks, recre-
     2  ation and historic preservation law, as amended by chapter  283  of  the
     3  laws  of  2016,  is  designated  subdivision 1 and is amended to read as
     4  follows:
     5    1. The commission is hereby established  as  a  not-for-profit  corpo-
     6  ration.    The commission shall be governed by the not-for-profit corpo-
     7  ration law except where such law conflicts with this article,  in  which
     8  case  the  provisions of this article shall govern. The commission shall
     9  consist of up to [thirteen] eleven voting members and  seven  non-voting
    10  ex-officio members.  One member each shall be appointed by the governor,
    11  the  temporary president of the senate, and the speaker of the assembly.
    12  Other members shall include the mayor of the city of Buffalo, or his  or
    13  her designee, a representative of museum studies at the state university
    14  of New York College at Buffalo, [two representatives] one representative
    15  of  the  department  of Afro-American studies at the state university of
    16  New York at Buffalo, [a representative from the Monroe Fordham  regional
    17  history  center at the state university of New York College at Buffalo,]
    18  a representative from WUFO Studios, and a representative from each board
    19  governing the J.  Edward Nash House, the Michigan Street Baptist Church,
    20  the Langston Hughes Institute,  and  the  Colored  Musicians  Club.  All
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  appointments  shall be residents of the city of Buffalo, but the commis-
     2  sion has the authority to waive this requirement at its  discretion.  In
     3  addition, seven non-voting members shall serve ex-officio: the secretary
     4  of  state,  the  commissioners  of  the  office of parks, recreation and
     5  historic preservation, environmental conservation, economic  development
     6  and  education,  one member from the congregation of the Michigan Street
     7  Baptist Church or their designee  and  the  president  of  the  city  of
     8  Buffalo's convention and visitor's bureau, or their designees.  Appoint-
     9  ments  to  the commission shall be filed with the commissioner who shall
    10  convene the first meeting of the commission following the  filing  of  a
    11  majority of the appointments. At the initial meeting, the members of the
    12  commission shall elect officers.
    13    § 2. Section 3 of chapter 595 of the laws of 2007, amending the parks,
    14  recreation  and  historic  preservation law relating to establishing the
    15  Michigan  Street  African  American  Heritage  Corridor  commission   in
    16  Buffalo,  as  amended  by chapter 150 of the laws of 2017, is amended to
    17  read as follows:
    18    § 3. This act shall take effect immediately, provided that section two
    19  of this act shall expire and be  deemed  repealed  December  31,  [2019]
    20  2020.
    21    §  3.  This  act  shall  take effect immediately; provided however the
    22  amendments made to section 41.05 of the parks, recreation  and  historic
    23  preservation  law  made  by section one of this act shall not affect the
    24  repeal of such section and shall be deemed repealed therewith.
