          Committee on Energy
 
        AN ACT to amend the public authorities law and a chapter of the laws  of
          2017, amending the public authorities law relating to establishing the
          affordable residential green building program, as proposed in legisla-
          tive  bills numbers S. 3746-A and A. 4969-A, in relation to additional
          aspects of such program and requiring the state authority to furnish a
          report determining the benefits of providing new financial  incentives
          for the construction of affordable residential green buildings
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 1872-a of the public authorities law, as added by a
     2  chapter of the laws of 2017, amending the public authorities law  relat-
     3  ing  to  establishing the affordable residential green building program,
     4  as proposed in legislative bills numbers S. 3746-A  and  A.  4969-A,  is
     5  amended to read as follows:
     6    § 1872-a. Affordable residential green building program. Notwithstand-
     7  ing  any  law,  rule  or regulation to the contrary, the authority shall
     8  establish and administer a program pursuant to  standards  and  criteria
     9  established  by the authority which would provide [incentives to] infor-
    10  mation and resources including technical assistance, access to  industry
    11  standards, and financing available through the authority or other public
    12  or  private  sector  sources,  to  developers,  builders, design profes-
    13  sionals, and potential owners for the construction  of  new  residential
    14  buildings which are affordable.  [For purposes of this section, "afford-
    15  able"  means  where  the homebuyer has a household income which does not
    16  exceed the income limits defined by the state of New York mortgage agen-
    17  cy low interest rate mortgage program in the  non-target,  one-and  two-
    18  person  household  category  for  the  county  where  such  property  is
    19  located.] Such [incentives] resources shall be available based upon  the
    20  use  of  design  and building techniques established [or promulgated] by
    21  the  authority  which  promote  integrated  design  practices  for   new
    22  construction  smart growth and smart planning, [reduce] the reduction of
    23  greenhouse gas emissions, achieve energy efficiency  and  reduce  energy

     1  consumption, [facilitate] encourage the incorporation of environmentally
     2  responsible products, promote the efficient use of all heating fuels and
     3  natural  resources,  reduce  waste and [create] promote a healthy indoor
     4  living environment while maintaining affordability for household incomes
     5  as  provided  in this section. The authority shall [promulgate rules and
     6  regulations] create and  maintain  guidelines  to  establish  affordable
     7  green  residential  building  standards  and  criteria,  [in addition to
     8  administrative regulations] and to connect potential  owners,  builders,
     9  developers, and design professionals associated with the construction of
    10  residential  buildings  with resources for financing, best practices for
    11  construction, and other  information  to  achieve  these  standards  and
    12  criteria for implementation of such program. The authority shall prepare
    13  an  annual  report on such program which shall be posted on the authori-
    14  ty's website.
    15    § 2. A chapter of the laws of 2017, amending  the  public  authorities
    16  law  relating  to establishing the affordable residential green building
    17  program, as proposed in legislative  bills  numbers  S.  3746-A  and  A.
    18  4969-A, is amended by adding a new section 1-a to read as follows:
    19    §  1-a.  No  later than December 31, 2018, the authority shall issue a
    20  report to the governor, the temporary president of the senate,  and  the
    21  speaker  of  the  assembly,  determining  the  benefits of providing new
    22  financial incentives for  the  construction  of  affordable  residential
    23  green  buildings. The report shall include an analysis of the beneficial
    24  impacts of such incentives in  promoting  and  achieving  smart  growth,
    25  smart  planning,  reduced  greenhouse  gas emissions, energy efficiency,
    26  reduced energy consumption, incorporation of environmentally responsible
    27  products, efficient use of all  heating  fuels  and  natural  resources,
    28  reduced  waste, and healthy indoor living environments while maintaining
    29  affordability for potential owners.
    30    § 3. This act shall take effect on the  same  date  and  in  the  same
    31  manner as a chapter of the laws of 2017, amending the public authorities
    32  law  relating  to establishing the affordable residential green building
    33  program, as proposed in legislative  bills  numbers  S.  3746-A  and  A.
    34  4969-A, takes effect.
