        Introduced by M. of A. GALLAHAN -- read once and referred to the Commit-
          tee on Transportation
 
        AN  ACT  in  relation  to  authorizing and directing the commissioner of
          transportation to conduct a study on the feasibility of  removing  all
          existing  3-cable  guide rails on New York roadways; and providing for
          the repeal of such provisions upon expiration thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  1.  The  commissioner of transportation is authorized and
     2  directed to conduct a study on the feasibility of removing all  existing
     3  3-cable  guide rails on New York roadways and replacing such guide rails
     4  with safer modern alternatives. Such study shall  include,  but  not  be
     5  limited to:
     6    a. The approximate location and mileage within the state where 3-cable
     7  guide rails are still in use;
     8    b.  The  estimated  cost  to  remove and replace the remaining 3-cable
     9  guide rails and whether such costs would be primarily borne by the state
    10  or the localities where such rails are in use;
    11    c. The estimated duration the removal would take if conducted  in  the
    12  most  cost-effective  manner for both the state and affected localities;
    13  and
    14    d. The estimated impact on vehicle and motorist safety by removing and
    15  replacing 3-cable guide rails with modern alternatives.
    16    § 2. In conducting such study, the commissioner of transportation  may
    17  consult  with any federal, state, or local office, agency, or department
    18  and request information from any such entity that is relevant and  mate-
    19  rial to the completion of such study and subsequent report.
    20    § 3. Within one year after the effective date of this act, the commis-
    21  sioner  of  transportation shall prepare and submit to the governor, the
    22  temporary president of the senate, the  speaker  of  the  assembly,  the
    23  minority leader of the senate, and the minority leader of the assembly a
    24  report  containing  the  study's  findings concerning the feasibility of
    25  removing and replacing all existing 3-cable  guide  rails  on  New  York

     1  roadways  and  recommendations for legislative or other actions that can
     2  be undertaken to implement provisions as deemed feasible by such report.
     3    §  4.  This  act shall take effect immediately and shall expire and be
     4  deemed repealed one year after it shall have become a law.
