        Introduced  by M. of A. AMEDORE, BUTLER -- read once and referred to the
          Committee on Transportation --  committee  discharged,  bill  amended,
          ordered reprinted as amended and recommitted to said committee
 
        AN  ACT  relating  to  permitting  the  continued use of certain outdoor
          advertising signs
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section 1. Notwithstanding the provisions of section 88 of the highway
     2  law,  or any regulations adopted pursuant to such law, an outdoor adver-
     3  tising sign shall be allowed to continue to exist if such sign: (i)  was
     4  lawfully  in  existence  prior  to September 1, 1965; (ii) is located in
     5  Montgomery county and is visible from the New York  State  Thruway;  and
     6  (iii) was damaged by bad weather and rebuilt prior to January 1, 2007.
     7    §  2.  This  act shall be deemed repealed if any federal agency or any
     8  court of competent jurisdiction determines that this  act  would  render
     9  New York state ineligible for the receipt of federal funds.
    10    §  3.  This act shall take effect immediately; provided, however, that
    11  the commissioner of the department of transportation  shall  notify  the

    12  legislative   bill  drafting  commission  upon  the  occurrence  of  the
    13  provisions of section two of this act in order that the  commission  may
    14  maintain  an  accurate data base of the official text of the laws of the
    15  state of New York in furtherance of effecting the provisions of  section
    16  44 of the legislative law and section 70-b of the public officers law.
