AN ACT to amend the general municipal law, in relation to providing
amnesty for certain persons from penalties and liabilities resulting
from failure to perform snow, ice and dirt removal
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general municipal law is amended by adding a new
2 section 137 to read as follows:
3 § 137. Snow, ice and dirt removal; amnesty. 1. A requirement imple-
4 mented by any city having a population of one million or more to remove
5 snow, ice and dirt shall not apply to an owner, lessee, tenant, occu-
6 pant, or other person, having charge of any building or lot of ground in
7 such city that is: (i) a senior citizen; or (ii) a person with a disa-
8 bility.
9 2. Any person exempt from the snow, ice and dirt removal requirement
10 pursuant to subdivision one of this section who has received a notice of
11 violation, appearance ticket or summons indicating a violation shall be
12 granted amnesty from any civil penalty imposed for failure to remove
13 snow, ice or dirt. Such amnesty shall be granted when such city is
14 provided with proof that such person is: (i) a senior citizen; or (ii) a
15 person with a disability.
16 3. For purposes of this section: (i) the term "disability" means (a) a
17 physical, mental or medical impairment resulting from anatomical, phys-
18 iological, genetic or neurological conditions which prevents the exer-
19 cise of a normal bodily function or is demonstrable by medically
20 accepted clinical or laboratory diagnostic techniques or (b) a record of
21 such an impairment or (c) a condition regarded by others as such an
22 impairment. The term shall be limited to disabilities which prevent the
23 complainant from performing snow, ice and dirt removal in a reasonable
24 manner;
25 (ii) the term "senior citizen" means a person who is at least sixty
26 years of age.
27 § 2. This act shall take effect immediately.
