        Introduced  by  Sen. HOYLMAN -- read twice and ordered printed, and when

        AN ACT to amend the vehicle and traffic law, in relation  to  increasing
          the penalties for leaving the scene of an incident involving a wheeled
          non-motorized means of conveyance
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 2 of section 1240 of the  vehicle  and  traffic
     2  law,  as added by chapter 468 of the laws of 2001, is amended to read as
     3  follows:
     4    2. Leaving the scene of an incident involving a wheeled  non-motorized
     5  means  of  conveyance  without  reporting  in  the  second  degree  is a
     6  [violation] class A misdemeanor.
     7    § 2. Subdivision 2 of section 1241 of the vehicle and traffic law,  as
     8  added by chapter 468 of the laws of 2001, is amended to read as follows:
     9    2.  Leaving the scene of an incident involving a wheeled non-motorized
    10  means of conveyance without reporting in the first degree is a class  [B
    11  misdemeanor] E felony.
    12    § 3. This act shall take effect immediately.
