AN ACT to require financial reports from the New York state broadband
program office
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The New York state broadband office shall produce a written
2 "look back" report on all expenditures between April 13, 2015 and the
3 effective date of this act. The report shall state in clear detail how
4 the broadband office has used the $500,000,000 allocated for the New NY
5 Broadband Initiative in the FY2015-2016 Capital Projects Budget, in
6 addition to the $170,000,000 obtained from the Federal Communication
7 Commission's Connect America Fund.
8 The report shall include, but not be limited to:
9 (a) the total amount of public funds committed and expended by this
10 program;
11 (b) the total amount of private funds committed and expended by this
12 program;
13 (c) the location of each area receiving investments under this
14 program, including zip+4 codes;
15 (d) planned future investments by both public and private parties; and
16 (e) other information as the broadband office deems appropriate.
17 The report required under this section shall be published no later
18 than 180 days after the effective date of this act.
19 § 2. On an annual basis, the broadband office shall produce a written
20 report on all expenditures of the previous twelve months. This report
21 shall contain the same criteria as the look back report. The first annu-
22 al report shall be published no later than one year after the publishing
23 of the initial look back report required by section one of this act, and
24 shall continue through January 1, 2022.

1 § 3. The look back report and annual reports shall be posted conspicu-
2 ously on the broadband office's website. Additionally, a copy of the
3 report shall be sent to the:
4 (a) Temporary President of the Senate;
5 (b) Speaker of the Assembly;
6 (c) Chair of the Senate Energy and Telecommunications Committee; and
7 (d) Chair of the Assembly Energy Committee.
8 § 4. This act shall take effect immediately.
