        Introduced  by  Sen.  ALESI  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
 
        AN ACT to amend the penal law, in relation to the crime of false  perso-
          nation
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Section 190.23 of the penal law, as added by chapter 69  of
     2  the laws of 1997, is amended to read as follows:
     3  § 190.23 False personation.
     4    A  person is guilty of false personation when [after being informed of
     5  the consequences of such act,] he or she knowingly misrepresents his  or
     6  her  actual  name, date of birth or address to a police officer or peace
     7  officer with intent to prevent such police officer or peace officer from
     8  ascertaining such information.
     9    False personation is a class [B] A misdemeanor.
    10    § 2. This act shall take effect on the first of November next succeed-
    11  ing the date on which it shall have become a law.
