AN ACT to amend the vehicle and traffic law, in relation to authorizing
the issuance of license plates bearing the words "Cure Childhood
Cancer"; and to amend the state finance law, in relation to establish-
ing the cure childhood cancer trust fund
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 404-ff to read as follows:
3 § 404-ff. Distinctive "Cure Childhood Cancer" plates. 1. Any person
4 residing in this state shall upon request be issued a distinctive plate
5 bearing the words "Cure Childhood Cancer". Application for such plates
6 shall be filed with the commissioner in such form and detail as the
7 commissioner shall prescribe.
8 2. Any distinctive plate issued pursuant to this section shall be
9 issued in the same manner as other number plates upon the payment of the
10 regular registration fee prescribed by section four hundred one of this
11 article provided, however, that an additional annual service charge of
12 fifty dollars shall be charged for such plate. Such annual service
13 charge shall be deposited pursuant to the provisions of section four
14 hundred four-oo of this article to the credit of the department of motor
15 vehicles distinctive plate development fund established by section nine-
16 ty-five-g of the state finance law, and shall be used for the
17 production, design, advertising and marketing of distinctive license
18 plates pursuant to such section ninety-five-g; provided, however, that
19 annual service charges collected in excess of four thousand dollars
20 shall be deposited to the credit of the "cure childhood cancer trust
21 fund" established pursuant to section ninety-nine-ff of the state
22 finance law and shall be used for childhood cancer research and educa-

1 tion projects approved by the commissioner of health or to provide
2 grants to state university of New York health science centers or univer-
3 sity hospitals for the purpose of researching and promoting a cure for
4 childhood cancer, pursuant to such section ninety-nine-ff.
5 § 2. The state finance law is amended by adding a new section 99-ff to
6 read as follows:
7 § 99-ff. Cure childhood cancer trust fund. 1. There is hereby estab-
8 lished in the joint custody of the commissioner of taxation and finance
9 and the comptroller, a special fund to be known as the "cure childhood
10 cancer trust fund".
11 2. Such fund shall consist of all revenues received pursuant to the
12 provisions of section four hundred four-ff of the vehicle and traffic
13 law and all other moneys appropriated, credited or transferred thereto
14 from any other fund or source pursuant to law. Nothing contained in this
15 section shall prevent the state from receiving grants, gifts or bequests
16 for the purposes of the fund as defined in this section and depositing
17 them into the fund according to law.
18 3. Monies of the fund shall be expended for pediatric cancer care,
19 treatment and wellness to include, but not be limited to physical and
20 occupational therapy, art therapy, counseling, research grants and
21 educational projects. Such funds will be expended through a grant proc-
22 ess created by and on the recommendation of the commissioner of health
23 to integrative medical facilities, state of New York health centers,
24 university hospitals or community-based not-for-profit organizations
25 that operate childhood cancer awareness and support programs.
26 4. Monies shall be payable from the fund on vouchers recommended by
27 the commissioner of health, after audit and approval by the state comp-
28 troller and office of the attorney general.
29 5. To the extent practicable, the commissioner of health shall ensure
30 that all monies received during a fiscal year are expended prior to the
31 end of that fiscal year.
32 § 3. This act shall take effect on the one hundred eightieth day after
33 it shall have become a law; provided, however, that effective immediate-
34 ly, the addition, amendment and/or repeal of any rule or regulation
35 necessary for the implementation of this act on its effective date are
36 authorized and directed to be made and completed on or before such
37 effective date.
