        Introduced  by  Sen.  PARKER -- read twice and ordered printed, and when
          printed to be committed to the Committee on Internet and Technology
 
        AN ACT to amend the public authorities  law,  in  relation  to  emerging
          technology industrial classifications for clean environment and energy
          technologies

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subparagraph 6 of paragraph (b) of subdivision 1 of section
     2  3102-e of the public authorities law, as added by section 3 of part I of
     3  chapter 407 of the laws of 1999 and as renumbered by section 4 of part D
     4  of chapter 59 of the laws of 2004, is amended and a new  subparagraph  7
     5  is added to read as follows:
     6    (6)  remanufacturing technologies, which shall be defined as processes
     7  whereby eligible commodities are restored to their original  performance
     8  standards  and are thereby diverted from the solid waste stream, retain-
     9  ing the majority of components that have been through at least one  life
    10  cycle and replacing consumable portions to enable such commodities to be
    11  restored  to their original functions. For the purposes of this subdivi-
    12  sion, "eligible commodities" shall mean  commodities  (excluding  paper)
    13  used  in conjunction with or as a part of equipment performing the func-
    14  tions of facsimile machines, photocopiers, printers, duplication  equip-
    15  ment,  or  any  combination  thereof,  including, but not limited to the
    16  following: magnetic ink character recognition cartridges, photo  conduc-
    17  tor  assemblies,  electrostatic  cartridges, thermal imaging cartridges,
    18  toner cartridges, ink jet cartridges, and printer  cartridges.  Provided
    19  further,  that  "eligible commodities" shall also include equipment used
    20  to record single frame images on film, where such equipment and film are
    21  marketed and sold as a single integrated  consumer  product,  and  where
    22  such  equipment  and  film  may  be  submitted  in whole to a photograph
    23  processor for the purposes of processing[.]; and

     1    (7) clean environment and energy technologies  that  involve  new  and
     2  innovative pollution reduction methods, renewable resource energy gener-
     3  ation  or  storage,  and  energy efficiency measures such as smart grid,
     4  automated or computerized energy control  systems  designed  to  deliver
     5  electric  generation  to  the  end  use customer in an integrated manner
     6  using the latest advances in digital  and  informational  technology  to
     7  improve electric system efficiency, reliability, and security.
     8    § 2. This act shall take effect immediately.
