AN ACT to amend the general municipal law, in relation to the town of
Islip industrial development agency
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The opening paragraph of section 898-b of the general
2 municipal law is designated subdivision 1 and a new subdivision 2 is
3 added to read as follows:
4 2. In addition to the powers and duties now or hereafter conferred by
5 title one of this article, the agency shall have the power (i) to
6 acquire, construct, renovate, own, maintain, and lease or sell to a
7 private business corporation or private business entity any interest in
8 any project where facilities or property that are primarily used in
9 making retail sales to customers who visit such facilities constitute
10 more than one-third of the total project costs located in the town of
11 Islip, including, easements and right of ways and all necessary and
12 related equipment convenient for the operation of such project, where
13 such projects are to be located on land owned or formerly owned by the
14 town of Islip and the project applicant or project developer has been
15 selected by the town of Islip pursuant to a competitively bid request
16 for proposals and such project applicant or project developer has agreed
17 on behalf of the town of Islip to complete an environmental cleanup of
18 the site and the town board of the town of Islip has approved all
19 economic assistance to be granted by the agency to the project applicant
20 or project developer and any subleases of the project, (ii) to finance
21 such facilities through the issuance of its bonds and notes and the
22 granting of financial assistance, when in the judgment of the agency,
23 such facilities will serve to promote, develop, encourage and assist in
24 the acquiring, constructing, reconstructing, improving, maintaining,
25 equipping and furnishing of industrial, manufacturing, warehousing,

1 commercial, retail and research facilities including industrial
2 pollution control facilities and thereby advance the job opportunities,
3 health, general prosperity and economic welfare of the people of the
4 state and improve their prosperity and standard of living.
5 § 2. This act shall take effect immediately.
