                STATE OF NEW YORK
        ________________________________________________________________________

                                         6326--A
            Cal. No. 1253

                               2017-2018 Regular Sessions

                    IN SENATE

                                      May 11, 2017
                                       ___________

Introduced by Sen. GOLDEN -- read twice and ordered printed, and when
printed to be committed to the Committee on Cities -- reported favora-
bly from said committee, ordered to first and second report, ordered

in the order of third reading

AN ACT to amend the administrative code of the city of New York, in
          relation to clean air taxicabs

The People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

1 Section 1. Legislative intent. The legislature finds that, to promote
2 the safety and well-being of all New Yorkers who live in or visit New
3 York city, there is a need to have fuel efficient, low emission and zero
4 emission options available for taxis. The current regulations that apply
5 to taxi vehicles has resulted in the selection of vehicles that have
6 high fuel usage and emissions. This policy must be changed to add more
7 fuel-efficient and lower emission choices.
8 § 2. Section 19-502 of the administrative code of the city of New York
9 is amended by adding two new subdivisions dd and ee to read as follows:
10 dd. "Hybrid electric vehicle" means a commercially available mass
11 production vehicle originally equipped by the manufacturer with a
12 combustion engine system and electric propulsion system that operate in
    13 an integrated manner.
14 ee. "Clean air taxis" means all taxicabs that are hybrid electric
    15 vehicles or electric vehicles.
16 § 3. Section 19-533 of the administrative code of the city of New
17 York, as amended by local law 53 of the city of New York for the year
18 2006, is amended to read as follows:
19 § 19-533 Clean air taxis. [The commission shall approve one or more
20 hybrid electric vehicle models for use as a taxicab within ninety days
21 after the enactment of this law. The approved] The commission shall
22 permit all hybrid electric and electric models of vehicles to be used as

EXPLANATION--Matter in italics (underscored) is new; matter in brackets
[ ] is old law to be omitted.
                                                                   LBD11740-02-7

1 a taxicab that also meet all requirements for use as a for-hire vehicle.
2 Such vehicle model or models shall be eligible for immediate use by all
3 current and future medallion owners. For the purposes of this chapter, a
4 hybrid electric vehicle shall be defined as a commercially available
5 mass production vehicle originally equipped by the manufacturer with a
6 combustion engine system together with an electric propulsion system
7 that operates in an integrated manner.
8 § 4. This act shall take effect on the ninetieth day after it shall
9 have become a law; provided, however, that the New York city taxi and
10 limousine commissioner shall promulgate rules and regulations necessary
11 to effectuate this act prior to such effective date.
